TERMS OF SERVICE

Goulongs are an original species created by Lydia/Lycchii and owned by Lydia/Lycchii and Kasey/Kasettetape and by owning one you automatically agree to these terms and services.

Design Rules

  • In order to be considered an official goulong, designs must adhere to the species standards outlined on the website.
  • When designing a MYO goulong, you may be asked to edit the design to adhere to the species standards.
  • Designs are not considered official until approved by a moderator.
  • MYO Designs/Design Edits may NOT be posted publicly anywhere until they are approved. Doing so may result in a warning. MYO Designs/Designs Edit that have not been approved may be uploaded privately and shared with friends.
  • Design edits of any kind must be approved by a moderator.
  • Design edits must be sent to the group via note for approval.

Payment

  • All payment must be made through PayPal in USD unless otherwise stated.
  • Payment must be made in full 48 hours after purchase.
  • Payment plans must be arranged prior to purchase via note, only on $300 and over. Payment plans are only allowed on auctions/sales that allow them.
  • Due to Paypal's policy regarding transactions with an underage party (18 and under being considered underage), we reserve the right to refuse sale to you if you are underage. This will be handled in a case by case basis, and we will discus the matter with the buyer if we suspect or know that they are underage. Purchases of $100 and under are exempt from this but we cannot protect you or take responsibility if you break Paypal's policies.

Creator Rights and Intellectual Property


  • We claim all rights to the goulong species, designs created by us, and images created by us. Please respect our personal TOS in conjunction to this.
  • No one may claim ownership of the goulong species besides Lydia/Lycchii and Kasey/Kasette.
  • We reserve the right to refuse service to and blacklist those who have failed to follow the rules outlined in these TOS, Rules outlined in our group and potentially rules outlined by DeviantArt.com.
  • We reserve the right to make changes, additions and updates to the goulong species, which may require existing owners to acknowledge.

Customer and Artist Rights


  • We claim all rights to the goulong species, designs created by us, and images created by us.
  • The customer/owner may not claim to own the Goulongs species. Doing so will cause them to be potentially blacklisted.
  • The customer/owner cannot use and sell their goulongs for commercial gain. Please refer to the ownership rules for further information about selling your goulong.
  • The customer/owner partially owns the design they have purchased/received. They do not own the traits, features and qualities that are unique to Goulongs and only own that specific design/character.
  • the customer/owner has the right to name and to develop a personality and backstory for their goulong. For information about goulong world canon, please refer to the website.
  • The customer/owner has the right to draw, post and talk about their character/design wherever they please as long as proper credit is given to both the designer and to the species.
  • The customer/owner cannot use their goulong and its design/character for commercial use or distribution. The customer/owner MAY use their goulong design/character as the subject of self-promotion of art sale.
  • Artists retain all right to their artwork of goulongs. Artwork cannot be edited or posted elsewhere without express permission from the artist.
  • Artists may use their artwork of goulongs for self-promotion.
  • Artists may NOT use goulongs for mass produced commercial endeavors.
  • Artists may create commercial artwork for private owners E.G. Your Character Here, Commissioned Artwork, etc.
  • Under no circumstances is anyone other than official artists or guests artists allowed to create and sell goulong designs. Being caught doing so will result in immediate blacklist and barring from any further interaction in the goulong community.

Ownership Rules


  • co-owning is not allowed.
  • Any trades or sales of goulongs must be notified to the group via note by the trader/seller. Multiple failures to do so may result in a warning.
  • The customer/owner may trade or gift their goulong to anyone not blacklisted.
  • The customer/owner may trade their goulong for other characters or designs, art, physical items or services.
  • The customer/owner may sell their goulong, but ONLY if the goulong was officially purchased through monetary exchange. This applies to flat sales, auctions and MYO goulongs. Goulongs acquired in Give aways, raffles, prizes, trades or any other manner that did not include a monetary exchange cannot be sold.
  • The customer/owner may only sell their goulong if they originally acquired it through monetary exchange. Goulongs that have been traded through something other than a monetary exchange will lose their monetary value.
  • The customer/owner may sell their goulong for equal to or less than the original buy value. If you are not sure about the original price of your goulong, please contact the goulongs group via note.
  • The customer/owner may trade their goulong for a voucher of equal to or less than the original buy value. If you are not sure about the original price of your goulong, please contact the goulongs group via note.
  • The customer/owner may sell or trade their MYO slot, but, as with all trading, the group MUST be notified by the trader.
  • While we may monitor and confront issues that arise during trades, we cannot be held responsible if you did not receive something you were promised in an arranged trade with another member. If you feel you have been scammed please contact the group via note concerning the matter.

A question; I was thinking of slightly altering the colors (NOT the overall design) of a MYO Goulong I acquired. Am I allowed to do so, if I did not design the MYO?
